Terms and Privacy Policy

This document explains the rules for using Tour of Phrase and how personal data is handled. In this document, “we”, “us”, and “our” mean Abkanali, the operator of Tour of Phrase at tourofphrase.com. By using the site, you agree to these Terms. The Privacy Policy applies whenever you visit or use the site.
Terms
1. The service
Tour of Phrase is a word-puzzle game provided for personal entertainment. We may add, change, suspend, or discontinue puzzles, features, or the service at any time. We do not promise that a new puzzle will be available every day or that the service will always be uninterrupted or error-free.
2. Acceptable use
You may use the site for lawful, personal, non-commercial purposes. You must not interfere with the site, bypass security or rate limits, access non-public systems, use automated means that burden the service, submit malicious code, or use the site in a way that violates another person’s rights or applicable law.
3. Ownership
Except where stated otherwise, Abkanali owns or licenses the rights in the site’s branding, software, design, selection and arrangement, original puzzle structures, and other elements protected by law. Some site material was created with generative-AI assistance and then selected, arranged, reviewed, or edited by us. Our copyright notice applies to the site as a whole and to individual elements only to the extent that applicable law protects them. It does not claim ownership of quotations, public-domain material, or third-party works, which remain subject to their respective rights. No ownership rights are transferred to you.
4. Advertising and third-party services
The site may display advertising and use services supplied by third parties, including Google. We do not control third-party services, advertisements, or their availability. Your dealings with an advertiser or third-party service are between you and that provider.
5. Disclaimers and responsibility
The site is provided “as is” and “as available”, to the fullest extent permitted by law. Use is at your own risk. We disclaim warranties that are not expressly required by law. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, revenue, or opportunity arising from use of, or inability to use, the site. Nothing in these Terms excludes liability that cannot lawfully be excluded.
6. Changes and termination
We may revise these Terms when the service or law changes. The effective date above will be updated when revisions are published. Continued use after a revision means you accept the revised Terms. We may restrict access where reasonably necessary to protect the site, other users, or comply with law.
7. Governing law
These Terms are governed by the laws of Jamaica, without regard to conflict-of-law principles. The courts of Jamaica will have jurisdiction over disputes, except where applicable consumer law gives you a right to bring a claim elsewhere.

8. Who controls your data
Abkanali is the data controller for personal data it determines how and why to process. Privacy questions and requests may be sent to hello@tourofphrase.com.
9. Data stored on your device
The game uses browser storage to remember puzzle progress, completion statistics, theme preference, and whether onboarding has been dismissed. This information stays on your device unless you clear it. It is needed to provide the saved-game features you request and is not used by us to identify you.
10. Data collected when you use the site
When analytics or advertising is enabled, we and our service providers may process:
- IP address and approximate location;
- browser, device, operating-system, language, and network information;
- page URLs, referral source, dates, times, and interactions with the site;
- game events such as starting, requesting a hint, or completing a puzzle; and
- cookies, advertising identifiers, consent choices, and ad interaction data.
We do not ask you to create an account, and the game does not require your name, postal address, phone number, or payment details.
11. Why data is processed
Data is processed to operate and secure the site, remember requested settings, diagnose faults, understand aggregate use, improve puzzles and features, measure audience and advertising performance, prevent fraud, and fund the service through advertising. Depending on the activity and applicable law, processing is based on your consent, providing a service you request, compliance with legal obligations, or our legitimate interests in operating, securing, improving, and supporting the site where those interests are not overridden by your rights.
12. Cookies, Google Analytics, and Google AdSense
Essential browser storage supports saved progress, statistics, preferences, security, and consent choices. With the required consent, Google Analytics may use cookies or similar technology to measure visits and interactions. Google AdSense and its advertising partners may use cookies or similar technology to deliver, limit, personalise, and measure ads, and to detect fraud and abuse. Google may receive the page URL, IP address, device and browser information, cookie or advertising identifiers, and interaction data. Learn how Google collects and uses data. Where required, non-essential analytics and advertising storage will not be activated until you make a consent choice. You may withdraw or change that choice through the site’s privacy controls when those services are enabled. Withdrawing consent does not affect earlier lawful processing.
13. Sharing and international processing
We may share data with providers that host, secure, analyse, or monetise the site, including our hosting provider and Google for Analytics and AdSense. These providers may process data outside Jamaica, including in the United States and other countries where privacy laws differ. We will use contractual, organisational, and other safeguards required by the Jamaica Data Protection Act, 2020 for international processing. We may also disclose data when required by law, to protect legal rights or safety, or as part of a business reorganisation subject to appropriate safeguards. We do not sell personal data directly to data brokers.
14. Retention
Browser-stored game data remains until you clear site data. Operational and security logs are kept only as long as reasonably needed for security, troubleshooting, and legal obligations. When enabled, Google Analytics event-level data will be configured for retention for no longer than 14 months. Advertising and consent records are kept according to the settings and retention rules of the relevant providers and for only as long as needed for the purposes described above. Data is then deleted or anonymised unless law requires longer retention.
15. Your data-protection rights
Subject to the Jamaica Data Protection Act, 2020 and applicable exceptions, you may ask whether we process your personal data; request access to it; ask for inaccurate data to be corrected; object to or ask us to stop certain processing, including direct marketing; withdraw consent; and seek review of certain significant automated decisions. You may also complain to Jamaica’s Office of the Information Commissioner. We may need information to verify your identity before completing a request.
16. Children
The site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal data directly from children under 13. If you believe a child has provided personal data, contact us so it can be reviewed and deleted where appropriate.
17. Security and breaches
We use reasonable technical and organisational measures designed to protect personal data. No internet service is completely secure. If a personal-data breach occurs, we will investigate and notify the Office of the Information Commissioner and affected people when required by law.
18. Privacy-policy changes
We may update this Privacy Policy to reflect changes to the site, our providers, or the law. Material changes will be identified by an updated effective date and, where appropriate, a notice on the site or a renewed consent request.
